Norway ratified the Rome Statute in 2000 and implemented the co-operation provisions the same year, through Act No. 65 of 15 June 2001 relating to the implementation of the Statute of the International Criminal Court of 17 July 1998 (the Rome Statute) in Norwegian law. This implementation relies heavily on the principle of presumption, which requires that statutes are implemented in the way that best respects Norway’s international obligations. The Act also applies provisions of the Criminal Procedure Code to requests for co-operation by the International Criminal Court. More recently Norway has implemented the crimes contained in the Rome Statute by amending its Penal Code through the addition of a new chapter 16. This amendment follows criticism of the previous Norwegian position by the ICTR in the Bagaragaza case. The previous position had been to rely on the offences already contained in the Penal Code when prosecuting the international crimes contained in the Rome Statute.
