Overview

Costa Rica implemented the crimes within the jurisdiction of the ICC by amending the article of its Criminal Code dealing with international crimes and adding two new articles to the same code. The crimes of genocide, crimes against humanity and war crimes are not defined in the Criminal Code, but reference is made to international treaties to which Costa Rica is a party. The Criminal Code provides domestic courts with universal jurisdiction in relation to these offences. The criminal code has no specific provision on command and superior responsibility. No legislation has currently been adopted which would allow Costa Rica to cooperate with the Court.
