SPECIFIC AGREEMENTS

10. Inconsistency

(2) For greater certainty, if there is an inconsistency between this Act and a specific agreement, this Act prevails to the extent of the inconsistency.

ANALYSIS

This provision is narrower than the ICC Statute.

 

The Extradition Act 1999 provides that, in the event of inconsistancy between national law and the Rome Statute, that national law is to prevail.
