Chapter 3. Conditions governing criminal liability

Section 43.

When the law provides for an increased penalty in cases in which a criminal act entails some unforeseen consequence, such penalty shall only be applicable when the perpetrator could have foreseen the possibility of such a consequence, or if he has failed to prevent it to the best of his ability after he has become aware of the risk.
