Chapter II. General Conditions for Imposition of Penalties.
Art. 17
A penalty shall be ordered although an offence has been committed under the heavy influence of alcohol or other drugs. A penalty shall, however, not be ordered if the offender was completely unconscious, unless he or she knew in advance, or had full reason to expect, that the offence would be committed under such influence or that the offence would follow from this his/her condition.
