SECTION II: JURISDICTION OF THE COURT

Art. 7 Determination of jurisdiction

1 If the Court claims jurisdiction over proceedings, the Central Authority may, in agreement with the competent authorities in the Swiss proceedings, assert Swiss jurisdiction as indicated in article 18 of the Statute or may, if necessary, challenge the jurisdiction of the Court in accordance with article 19 of the Statute.

2 If the Central Authority does not challenge the jurisdiction of the Court or if the Court, upon consideration, reaches the conclusion that its jurisdiction takes precedence, then all documents pertaining to the proceedings shall be transmitted to the Court. The competent
Swiss authorities shall suspend the proceedings.

3 Decisions on challenges to jurisdiction cannot be appealed.
